1. Agreement to Terms

By accessing or using AppTrailer ("Service"), available at apptrailer.dev, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.

The Service is operated by AppTrailer ("we", "us", "our"). We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

AppTrailer is a web-based tool that generates short promotional videos for mobile applications. Users provide an App Store or Google Play link (or app name), and the Service creates a cinematic promo video using the app's publicly available metadata (name, icon, description).

The Service offers free and paid tiers. Free videos include a watermark and are limited in format and resolution. Paid videos ("Pro") remove the watermark, include all formats, full HD resolution, and audio.

3. User Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to use this Service. By using the Service, you represent that you meet this requirement.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to promote illegal activities.
• Generate videos for apps you do not own or have authorization to promote.
• Misrepresent, impersonate, or create misleading promotional content for apps belonging to third parties.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Interfere with, disrupt, or place undue burden on the Service or its infrastructure.
• Use automated tools (bots, scrapers) to access the Service without prior written consent.
• Circumvent or attempt to circumvent any security measures, watermarks, or access restrictions.

5. Intellectual Property

5.1 Your Content

You retain all rights to your app's name, icon, and branding. By using the Service, you grant us a limited, non-exclusive license to process this content solely for the purpose of generating your video. We do not claim ownership of your content.

5.2 Generated Videos

Videos generated through the Service are yours to use for promotional purposes. You are responsible for ensuring you have the right to use all app branding and assets included in the video.

5.3 Our Property

The Service itself, including its design, templates, animations, code, audio tracks, and branding, is our intellectual property and protected by applicable copyright and trademark laws. You may not copy, reproduce, or redistribute any part of the Service.

5.4 Audio Tracks

Audio tracks provided within the Service are licensed for use exclusively in videos generated by AppTrailer. You may not extract, download, or use these audio tracks separately or in any other context.

6. Third-Party App Data

The Service retrieves publicly available app information from Apple App Store and Google Play Store (app name, icon, description, category). This data is used solely to generate your video and is not stored beyond the video creation process.

We are not affiliated with Apple Inc. or Google LLC. "App Store" is a trademark of Apple Inc. "Google Play" is a trademark of Google LLC.

7. Payments and Billing

7.1 Pricing

Pro videos are available as a one-time purchase. Prices are displayed at the time of checkout and are subject to change. There are no recurring charges or subscriptions.

7.2 Payment Processing

Payments are processed securely by Stripe, Inc. We do not store your credit card details. All payment data is handled in accordance with PCI DSS standards. By making a purchase, you also agree to Stripe's Terms of Service.

7.3 Refund Policy

Due to the digital nature of the product, all sales are final. However, if you experience a technical issue that prevents you from receiving your video, contact us and we will work to resolve it or issue a refund at our discretion.

8. Video Delivery and Storage

Generated videos are available for download immediately after rendering. Video files are stored temporarily and may be deleted after 72 hours. It is your responsibility to download your video within this period. We are not obligated to retain or re-generate videos after deletion.

9. Free Plan

The free plan requires a valid email address and consent to receive product updates. Free videos include a visible watermark, are limited to 720p resolution, specific formats (9:16, 1:1), and do not include audio. We reserve the right to modify or discontinue the free plan at any time.

10. Showcase / Client Gallery

Paid videos may be featured in our "Our Clients" section on the landing page, displaying the app icon and name. This is limited to publicly available app store data. If you wish to opt out of the showcase, contact us and we will remove your entry promptly.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific results from using the Service, including but not limited to increased downloads, engagement, or revenue for your app.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless AppTrailer and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to the Service, other users, or third parties.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and applicable local laws. Any disputes shall be resolved in the courts of the jurisdiction where the operator is established.
